Cause -

A landlord in Hertford had water ingressing through the side wall of his 1900's end terraced house. The problem had been caused by a broken gutter joint, we assessed the damage and submitted our report and building repair schedule to the insurers. The claim was rejected on the grounds that the problem was weather related and as the owner did not have accidental cover consequently the damage inside the property was not covered.

Outcome -

We did not accept this explanation and successfully argued that the gutter had been damaged during high winds causing it to break at a joint. This in turn caused the water to flow against the wall so the peril was an escape of water which was covered under the policy.
